Abstract

There are few studies that treat the construction of the judicial system in Spanish Guinea as a source for the study of colonial relations. The current text proposes to narrate its evolution and tensions, as well as interpreting some representative lawsuits of the Tribunals of Demarcation between 1938 and 1959. Guinea’s colonial justice was similar in structure to that implemented by other powers in that it was organized through a model of legal dualism based on the existence of European justice, under the Peninsular system, and racial justice, supposedly subject to customary law. The process of the institutionalisation of this model culminated in 1938, with the arrival of Franco’s regime, when colonial action intensified considerably. This article focuses primarily on this period and suggests that the system of Race Tribunals should be understood as the product of a two-way process (evidently unequal) between the colonized and colonizers; that is, a space where the state’s strategies of assimilation and social discipline interacted with resistance and the local appropriation of these devices.
