Abstract

In the provision of digital services, commercial operators have emerged as key subjects. These actors assume an even more accentuated role in the mechanism of the secondary market for the radio spectrum, whose purpose is flexibility and rationality in the use of this incorporeal good; all without prejudice to the bidding procedures. The secondary spectrum market brings together different legal businesses: the transfer of enabling titles, the assignment, the provision of relevant wholesale services or the mutualization of rights for the private use of the public radio domain. Meanwhile the first two are common in legal traffic, the latter are less frequent. This article focuses on the attractive and poorly studied business of frequency mutualization as a potential revulsive of the deployment of new telecommunications networks.
