Enforced disappearance is an international crime that implies and requires state participation. This criminal conduct undermines several protected legal rights such as life or freedom, not only of the victim of enforced disappearance but also those of the victim ́s family, such as the right to know the whereabouts of the family member kidnapped by state forces. Families of the disappeared are also victims. The enforced disappearance of persons must be interpreted as a permanent crime, and the family of the disappeared has the right to initiate criminal proceedings until the state gives a truthful answer as to the location of the disappeared family member.
