Laburpena

The application of Law 5/2019, of March 15, regulating real estate credit contracts, has caused doubts about its scope and, specifically, in cases which changes in the intervening subjects. We will study the notary act pre-contractual information and the formalization of the mortgage in the contracts of sale of the residential property, between consumers, with retention agreement, intervening or not, the active subject of the credit with mortgage. The “Consejo General del Notariado” and the “Colegio de Registradores de la Propiedad y Mercantiles” of Spain have made consults, in the Instruction of December 20, 2019, of the DGRN, on the notarial and property registrars’ action.
