Abstract

This chapter of book is a reflection on the various possibilities that European regulation offers to individuals so that they can access a court competent to divorce. The new Brussels IIb Regulation makes some subtle changes, mainly in one of its areas of application: the personal scope. This paper aims to explain the reasons that the European legislator has observed for these changes. At the same time, the different competition forums of the Brussels IIb Regulation and its alternatives will be reviewed, all with practical examples to verify the applicability of this Regulation. Private international law seeks in the application of its rules fair solutions in the cases that should be applied according to the criteria of predictability, proximity and good administration of justice.
