Abstract

Spanish criminal law punishes a series of conducts because they are assumed to be, implicitly or explicitly, caused by certain heinous and undemocratic reasons. In some cases, such as in the crime of (self)indoctrination for terrorist purposes, even a mere ideology seems to be punished. From a criminological point of view, this approach leads us to the theses of culturally motivated crimes, which point to certain values or attitudes as causes of crime and violence. Therefore, this empirical research has been implemented within the framework of the Subculture of Violence Theory. For this purpose, the database of ISRD2 Spain was used. A series of logistic and multilevel regression analyses suggest that values have a poor predictive capacity for crime and that these are better explained by other general theories of crime.
