Abstract

In this essay, the Hon. Mr. Dr. D. Jacobo Barja de Quiroga and Prof. Dra. Sonia Calaza López —with a choral vision— face a joint study of civil liability for physical and technological sexual violence, with an individualized analysis of both «psychological damage» and «moral damage»; and even, of the great forgotten, the «digital damage». The regulation of a good number of sexual crimes —in a pitifully growing scale— devised or materialized in the network —from the technological dissemination of non-consensual sexual content to the same digital extortion— imposes the couple the need to create a new concept of compensable damage in all this legal amalgam: the «digital damage» that also presents singularities worthy of mention, specificity and differentiated analysis with respect to the remaining concepts of damage, which are still the classic ones, reformulated and individualized now, but all of them conceived to quantify pain on a physical and/or psychological level, but —in any case— analogical.
