Resumo

The Spanish Supreme Court, in its Ruling 814/2020 of 5 May, deals, for the first time, with the judicial assessment of neuroimaging in the context of criminal proceed-ings. In this judgement, these are described as “accurate” and “indisputable”, regarding the de-termination of the volitional and cognitive capacity of the defendant. In this paper, a critical analysis of the judicial assessment is formulated, examining (i) where it emerges from, (ii) its incompatibility with the free evaluation of evidence and (iii) mismatch with the current state of neuroscience. It is concluded that the interpretation given to neuroimaging in this judg-ment must be amended in the future, as it does not converge with scientific or legal reality.
