La protección transfronteriza de adultos en la Unión Europeala propuesta de Reglamento en materia de protección de adultos

Abstract

The purpose of this contribution is the structure of the proposed Regulation on the protection of adults in the European Union; that is, international jurisdiction, applicable law, recognition and enforcement and recognition of measures and cooperation in matters of adult protection. To do this, the reasons that justify said proposal are taken into account, as well as the purpose of the instrument. It is argued that the existing divergence between the internal rules of the Member States regarding the protection of adults in need of protection affects a violation of their fundamental rights, recognizing the urgent need for a Regulation that harmonizes the rules of Private International Law on the protection of adults in the European Union.
