¿Qué debería ser un migrante climático para el derecho internacional?

Resumen

En este trabajo se construye una definición jurídica de migraciones climáticas en base a la realidad sociológica, el derecho internacional de protección de los derechos humanos y el principio del derecho ambiental internacional de responsabilidades comunes pero diferenciadas. Partiendo de un objeto amplio que vincule suficientemente la relación causal clima-migración, la definición se construye a partir de tres elementos. El primero, la protección de no devolución como protección mínima ante la afectación de los derechos humanos. El segundo, la flexibilización del reconocimiento de dicha protección cuando el evaluador es un Estado con contribuciones históricas de emisiones y el solicitante provenga de un Estados con poca capacidad de adaptación. El tercero, la ampliación de la protección a su familia (extensa) y, en los casos en que se de cumplan los mismos requisitos que el solicitante, a su comunidad, entendiendo a las migraciones climáticas como un proyecto compartido donde los más vulnerables son muchas veces los que no pueden llegar a desplazarse. Se deja como opcional el reconocimiento de una protección temporal para cualquier migrante, independientemente de los factores que impulsan la migración, que sufren efectos importantes del cambio climático in itirine.
