De las agresiones en el entorno escolar a la violencia digitalel "cyberbullying" en el derecho penal y la criminología

Résumé

Currently, the forms of harassment committed through ICT are those that concern society the most. The phenomenon of cyberbullying has spread among young people and it seems that it is a type of behaviour that is increasing globally. However, defining all the aspects related to the term cyberbullying is not an easy task. The present study will try, first of all, to make an approach to the criminological definition of cyberbullying, focusing on the main preventive problems in light of its quantitative and qualitative dimensions. Next, a subsumption of this concept will be made to the normative reality in our Penal Code, taking into account the criminal treatment related to this figure and the praxis of our courts. Finally, a brief mention will be made of other behaviours similar to cyberbullying or that are directly related to it and whose commission also specifically concerns young people and minors.
