In the present study we show that with the legislative modification carried out by Law 8/2021, of June 2, which reforms the civil and procedural legislation for the support of people with disabilities in the exercise of their legal capacity, a new diction to article 96 CC, thus solving most of the controversial issues that arose under the protection of the previous wording. In this context we analyze and emphasize the solutions given by the new article 96. 1 CC. In addition, we stop at the temporary limitation in the attribution of the use of the dwelling set by the new wording of article 96. 1 CC. Finally, this legislative amendment regulates the attribution of the use of the home in cases where there are children of legal age with disabilities.
